Education Governance & Regulation
Regulatory oversight of schooling, including the state's relationship with private schools, and the reliability of the data systems used to govern the sector.
2 problems within this
The Right to Education Act's 25% reservation in private schools is unevenly implemented and weakly monitored
Section 12(1)(c) of the RTE Act requires private unaided schools to reserve at least a quarter of entry-level seats for children from economically weaker and disadvantaged sections, with the state reimbursing the cost. CAG audits in more than one state have found deficiencies — chronic staff shortages and ineffective grievance redressal in monitoring in one state, delayed implementation and admission irregularities in another. Delayed reimbursement has periodically prompted private-school associations to threaten non-cooperation, and definitional ambiguity continues to generate litigation with divergent High Court outcomes. Implementation quality genuinely varies by state, with at least one state cited as implementing the provision without dilution. Evidence confidence: Medium-High — the CAG is an authoritative source and more than one state shows independently documented problems, but the audit findings were accessed through secondary reporting rather than the primary audit reports, and the national picture beyond the states named is not established.
Core education statistics are not reliable enough to hold anyone to account
The evidence base for governing the sector is itself contested. Teacher vacancies are officially reported as both around ten lakh and around 3.58 lakh; enrolment has fallen for several years with no agreed cause; public education spending is stated as very different shares of GDP depending on the source. AISHE participation is voluntary and self-reported, with only inbuilt validations as quality control by the Ministry's own description, and an independent state survey has directly disputed UDISE+ facilities data as misleading for that state. The move to Aadhaar-linked individual student records from 2022-23 is a real improvement and shows the Ministry is aware of the problem. Evidence confidence: Medium — each instance is individually well sourced, but these are scattered observations rather than a systematic audit of data quality. This problem bears on how confidently every other figure in this domain should be read.
